Privacy notice

In accordance with the provisions of the Federal Law on the Protection of Personal Data held by Private Parties (hereinafter referred to as the “LAW”) and the Regulations to the Federal Law on the Protection of Personal Data held by Private Parties (hereinafter referred to as the “REGULATIONS”), as well as the specifications and parameters set forth in the Privacy Notice Guidelines published in the Mexican Official Gazette of the Federation (DOF) on January 17, 2013, the legal entities named MEXICANA DE LUBRICANTES, S.A. DE C.V., AK NRG, S.A. DE C.V., AK LOGÍSTICA, S.A. DE C.V., OLSTOR SERVICES, S.A. DE C.V., VETTEROL, S.A. DE C.V. and MOVE FRANQUICIAS, S.A. DE C.V., as well as their affiliates, subsidiaries and related parts, having its domicile for the purposes hereof the one located at AVENIDA 8 DE JULIO 2270, COLONIA ZONA INDUSTRIAL, C.P. 44940, GUADALAJARA, JALISCO, MEXICO, we hereby inform you and make available this Integral Privacy Notice for the Protection of Personal Data (hereinafter referred to as the “Privacy Notice”).

Personal Data Responsable.

“AKRON” is responsible for the reception, management and protection of the Personal Data collected from you as the owner by any of the means made available to you. The Personal Data will be used by “AKRON” based on the treatment and for the purposes provided in this Privacy Notice, therefore the treatment of such Personal Data will be at all times legitimate, controlled and informed, the above in order to ensure the privacy of the same and compliance with the applicable regulatory framework.

Personal Data collected.

In order to achieve the purposes described in this Privacy Notice, “AKRON” will collect from its customers, distributors, suppliers, employees, service providers and in general from any person with whom “AKRON” has or intends to have any kind of relationship, the following data: (i) identification; (ii) contact; (iii) labor; (iv) academic; (v) professional; (vi) financial and/or patrimonial; (vii) commercial; among others that are necessary to document the relationship of “AKRON” with whoever provides the data (hereinafter the “Personal Data”).

All third parties Personal Data that are provided as reference or contact elements will be subject to the Personal Data protection measures implemented by “AKRON”, who agrees not to disclose or transmit such Personal Data, subject to the same terms set forth in this Privacy Notice.

The Personal Data will be provided directly and voluntarily by the owner thereof (the “Subject”) and will be collected by “AKRON” electronically (by e-mail and/or web pages), by telephone and/or in person.

“AKRON” will not collect sensitive personal data from you, such as religion, health status, sexual preference, political opinions and similar information.

Personal Data treatment purposes.

By this Privacy Notice, “AKRON” states that the Personal Data collected from you shall be used for the following purposes:

Identify the Subject.
Provide, fulfill and/or deliver the services and/or products the Subject has requested to “AKRON”.
To comply with all the obligations acquired by “AKRON” towards the Subject.
Analyze the Subject in order to initiate a possible relationship with him/her.
Drafting the contracts or covenants to be entered into by the Subject with “AKRON”.
Provide the Subject with information about the products and/or services offered by “AKRON”.
For “AKRON” to establish communication with the Subject.
For statistical purposes related to the products and/or services offered by “AKRON”.
To elaborate marketing strategies, commercial campaigns and promotions related to the products and/or services offered by “AKRON”.
Conduct quality control surveys.
To comply with the different legal, environmental, governmental and fiscal dispositions that are applicable to “AKRON”.

In addition, the Personal Data requested by “AKRON” to its collaborators and persons with whom it has a direct work relationship, will be used for the following purposes:

Contracts or agreements execution.
Identify and evaluate the collaborator candidate.
Integration of the candidate’s or employee’s file.
For consultations and records.
To comply with obligations before the social security authorities.

Personal Data transference.

By means of this Privacy Notice, we inform you that your Personal Data may be transferred and processed, inside and outside the country, by persons other than “AKRON”. In that sense, your Personal Data may be shared with the following persons, companies, organizations and authorities other than “AKRON” for the following purposes:

Financial Institutions. To make the payment and collection of payments to be made between the Subject and “AKRON.”
Suppliers and Business Allies. To comply with the obligations of “AKRON” in favor of the Subject.
Governmental Institutions and Competent Authorities. For due compliance by “AKRON” with the applicable regulatory framework.
Insurance Institutions. In order to make an evaluation of the risk that exists when “AKRON” initiates a relationship with the Subject.
External Consultants. To organize and regulate the operation of “AKRON”.

It is important to inform you that in addition to the above, “AKRON” may disclose, reveal and/or transfer, without your consent, inside and outside the country, the Personal Data collected, in the cases provided for in article 37 of the “LAW”.

Confidentiality

“AKRON” has implemented and maintains administrative, technical and physical security measures to protect your Personal Data, guaranteeing at all times the strict confidentiality and privacy of the same in order to avoid loss, misuse and/or alteration of your information, subject to the ‘LAW’ parameters, its ‘REGULATIONS’ and other applicable regulatory provisions. In addition to the foregoing, “AKRON” will safeguard the Personal Data obtained through databases that are managed solely and exclusively by the persons designated for such purposes, restricting all types of access to unauthorized persons, and under no circumstances “AKRON” will sell, rent, alienate, share, transmit or transfer Personal Data without the Subject consent.

ARCO Rights (Access, Rectification, Cancellation and Objection)

You, or your legal representative, duly accredited, may request, at any time, the access, rectification, cancellation and/or objection (hereinafter “ARCO Rights”) respect to your Personal Data.

The procedure to exercise the ARCO Rights will begin with the submission of a written request to “AKRON”’s domicile, or by sending an e-mail to the address aviso.privacidad@akron.com.mx. Such request must contain at least the following information:

Name and an address or other means to communicate the response to your request;
The documents proving the identity or, as the case may be, the legal representation of the Subject;
The clear and precise description of the Personal Data with respect to which you seek to exercise any of the ARCO Rights and;
Any other document or element that facilitates the Personal Data location.

“AKRON” undertakes to carry out the corresponding procedure in accordance with the ‘LAW’ provisions and its ‘REGULATIONS’ which may be carried out by writing at the domicile indicated in this Privacy Notice, as well as by sending an e-mail to the following address aviso.privacidad@akron.com.mx. “AKRON” will inform you of the decision adopted, within a maximum period of twenty (20) business days from the date on which the request was received, so that, if applicable, it will make the decision effective within fifteen (15) business days from the date on which the request was received.

For further information about the procedure to follow to enforce your ARCO Rights, the Subject may contact “AKRON” through the above mentioned e-mail address.

Consent revocation.

You may revoke at any time the consent that, if any, has been granted for the processing of your Personal Data, without retroactive effects. However, it is important to note that not in all cases we will be able to attend your request or stop the use of the same immediately, since it is possible that due to some legal obligation we may need to continue processing your Personal Data when there is a contractual relationship in force or an obligation to be fulfilled, being the revocation subject to the validity of the act that gave rise to the legal relationship with the Subject.

In case you wish to revoke your consent, you must make the request at the “AKRON” domicile indicated in this Privacy Notice, submitting a letter expressly indicating your name and the legend “I (Subject name) hereby appear to request ‘AKRON’ to revoke my consent for the processing of my Personal Data”, stating the reason for revocation, an e-mail address and address to notify the request response, the date of the request, a handwritten signature and a copy of a valid official identification. Likewise, the Subject may also make the request through electronic means, by sending an email to the address aviso.privacidad@akron.com.mx with all the above mentioned requirements.

Options and means to limit the use or disclosure of your Personal Data.

You may limit the use or disclosure of your Personal Data by sending a letter addressed to “AKRON”, with the following steps: indicating your full name, a simple copy of your official identification, telephone number, an address for notification purposes related to the case; to “AKRON’s” address indicated at the beginning of this Privacy Notice, or to the e-mail aviso.privacidad@akron.com.mx.

Web beacons and Cookies use.

“AKRON” websites uses cookies, web beacons and other technologies through which it is possible to recognize regular users and track their behavior on the Internet in order to provide a better service when browsing our website, as well as to offer products and services based on their preferences.

Cookies are data files that are stored on the hard disk of a user’s computer or electronic communications device when browsing a specific website, which allows the exchange of status information between the website and the user’s browser. On the other hand, web beacons are a visible or hidden image inserted within a website or e-mail, which is used to monitor the user’s behavior in these media, as well as to store information about the IP address, duration of interaction time on the page and the browser type used.

The Personal Data we obtain from these tracking technologies are used to obtain information based on the following purposes:

Determine the average duration of the visit;
New visits percentage;
Demographic data;
Visits frequency, and
Browser and operating system.

For questions or complaints regarding this Privacy Notice, “AKRON” provides the domicile indicated at the beginning of this Privacy Notice and the following email: aviso.privacidad@akron.com.mx, as well as for the mechanisms that have been implemented for the exercise of ARCO Rights and consent revocation.

The service hours will be Monday to Friday from 9:00 am to 5:00 pm.

Privacy Notice modifications.

This Privacy Notice may be modified, changed or updated due to new legal requirements, “AKRON”s own needs related to the products and/or services it offers, privacy practices or any other causes, for which “AKRON” reserves the right to make at any time the necessary modifications or updates to this Privacy Notice. “AKRON” will make available to you, the Privacy Notice updated version on the “AKRON” website, in which you will find the latest update made to the Privacy Notice.
