Terms and conditions

The terms and conditions of use described below (hereinafter referred to as the “Terms and Conditions”) constitute the binding, valid, and enforceable rules that will govern any person (hereinafter referred to as the “User” or, in plural, “Users”) who, by accepting the Terms and Conditions, initiates a contractual relationship via the Service Provision Adhesion Contract (hereinafter referred to as the “AKRON EV Contract”) with AK Logística, S.A. de C.V., a company incorporated under the laws of the United Mexican States, with its address at Avenida Américas 1506-116, Col. Country Club, C.P. 44610, Guadalajara, Jalisco, Mexico, its affiliates, subsidiaries, parent companies, and/or controlled companies, companies that are part of its economic group (currently or in the future), to which it may transfer its contractual position or assign its rights under the “AKRON EV Contract” (hereinafter referred to as “AKRON”), for the purpose of using the mobile software application called AKRON EV (hereinafter referred to as the “AKRON EV APP”).

Purpose.

These Terms and Conditions of the AKRON EV APP contain the rights and obligations between the parties for the use of the AKRON EV APP, with the purpose of allowing Users to charge their electric and/or hybrid vehicles at the AKRON EV electric vehicle charging stations (“AKRON EV Charging Stations” or “AKRON EV Charging Station”), owned by AKRON.
Through the AKRON EV APP, Users will be able to do the following: (i) identify which AKRON EV Charging Stations are available for the User to charge their electric/hybrid vehicle; (ii) choose the type of electric/hybrid vehicle charging (charging speed level), as well as its corresponding cost and payment; (iii) maintain a history of vehicle charges, charging receipts, and request invoices.

Acceptance of the Terms

The AKRON EV APP is available for download on Apple’s iOS and Android systems. By downloading the AKRON EV APP, the User agrees to have read and accepted the Terms and Conditions of the AKRON EV APP, as well as those of Apple’s iOS and Android systems.
Any person who does not accept the Terms and Conditions of the AKRON EV APP, which are mandatory and binding, must refrain from using the services offered in the AKRON EV APP.

AKRON does not guarantee, nor is it obligated to guarantee, the condition or compatibility of the AKRON EV Charging Stations with the User’s vehicle, the charging speed of their electric/hybrid vehicle, or the performance of the AKRON EV Charging Stations. AKRON guarantees that each AKRON EV Charging Station complies with all mandatory safety standards, legal or applicable to the industry for the operation of electric/hybrid vehicle charging stations.

By registering in the AKRON EV APP, Users will be able to use all AKRON EV Charging Stations, which are located in the Mexican Republic, as shown in the AKRON EV APP.

AKRON does not guarantee continuous or uninterrupted access and use of the AKRON EV APP, nor its performance, electrical supply, or the continuous availability of the AKRON EV Charging Stations. Both the AKRON EV APP and the AKRON EV Charging Stations may occasionally be unavailable due to technical difficulties, electrical issues, or Internet or telecommunications failures, or any other circumstance beyond AKRON’s control.

Users may not hold AKRON liable or demand any compensation for damages resulting from the aforementioned difficulties, as well as for any other type of damages, including consequential or incidental damages, indirect, special, or consequential damages that arise or are experienced by Users.

AKRON will attempt to resolve issues as soon as possible after becoming aware of them; however, AKRON does not guarantee that the operation of the AKRON EV APP will be continuous, complete, or error-free.

While AKRON strives to provide the most accurate information possible through the AKRON EV APP and its website akron.com.mx/electromovilidad, it cannot guarantee the accuracy of the information provided, as it may be affected by telecommunications issues, network failures, or other matters beyond AKRON’s control. The AKRON EV APP displays information about each AKRON EV Charging Station that is received intermittently through communications provided by a third party. Neither AKRON nor any external service provider guarantees that the information displayed through the AKRON EV APP is correct or up to date.

To use an AKRON EV Charging Station, the User must register in the AKRON EV APP. To identify the User, AKRON uses their email address to verify their account. Creating a user account requires certain personal data. In this regard, the User must provide true, current, and complete information and, in the event of any changes, must update this information immediately. The AKRON EV APP requires the User to choose a password. The User will be responsible for keeping this password secure to prevent any unauthorized use or access to their account. Therefore, the User will be solely and exclusively responsible for all operations carried out in their account, and AKRON will assume that all actions performed in the AKRON EV APP have been carried out by the User and that their stored information is correct. If the User experiences any suspicious activity in their account, they must contact AKRON immediately using the contact information provided here.

The User must ensure that charging sessions at the AKRON EV Charging Stations are carried out in accordance with the instructions in the AKRON EV APP and/or at the facilities where the AKRON EV Charging Station is located. The use of the AKRON EV APP, as well as the AKRON EV Charging Stations and/or their accessories, is the User’s responsibility. The User agrees to use the AKRON EV Charging Stations safely, with due care and reasonable skill, and will therefore be responsible for any misuse of the AKRON EV Charging Stations and/or their accessories. When charging cables are not provided at an AKRON EV Charging Station, the User will be responsible for providing the charging cables to connect their vehicle to the AKRON EV Charging Station. Only charging cables of a standard and quality not inferior to those recommended by the vehicle manufacturer may be used, and no damaged, defective, or modified charging cables may be used. It is the User’s responsibility to ensure that, when using the AKRON EV Charging Stations, they physically disconnect their vehicle from the AKRON EV Charging Station correctly once charging is complete. If a charging cable or accessory provided by the Charging Station has been used, the User must ensure that it is securely stored in the designated place after use. Please note that some AKRON EV Charging Stations may be located in areas where special parking rules apply, so the User will be responsible for complying with the parking rules where the AKRON EV Charging Station is located. Likewise, once charging is complete, the User must immediately leave the AKRON EV Charging Station and the location where it is situated. Failure to do so may result in additional charges for the use of the space.

The charging of an electric/hybrid vehicle depends on various factors, including, without limitation, the technical specifications of the vehicle in question, the battery’s charging level and capacity, and the charging station itself. These factors will affect the charging of any electric/hybrid vehicle. The User acknowledges and agrees that AKRON does not offer any guarantee regarding the amount of time required to charge an electric/hybrid vehicle using the AKRON EV Charging Stations.

It is strictly prohibited to alter or modify the entirety or any part of the AKRON EV Charging Stations, including their accessories, as well as to bypass, disable, or manipulate, in any way, the software of each AKRON EV Charging Station. The User will be responsible for leaving the accessories of the AKRON EV Charging Station in the same condition in which they were found.

The AKRON EV Charging Stations and the AKRON EV APP are provided “as is” for use at the User’s own risk. AKRON will not be liable to the User or any other person for any loss or damage to the User or their vehicle under these Terms and Conditions, the AKRON EV APP, the AKRON EV Charging Stations, or their accessories. AKRON is not and will not be responsible for the services of the AKRON EV Charging Stations, including, without limitation: a) charging services erroneously requested by the User, including, without limitation, a request for a charging speed higher than what the User’s vehicle can support; b) any charging that has been left incomplete or damaged for reasons beyond the AKRON EV Charging Station; c) sudden increase, unavailability, or interruption of the electricity supply; d) User error; e) use or inability to use the AKRON EV Charging Stations and/or their accessories; f) use or inability to use the AKRON EV APP; g) any third-party site linked from the AKRON EV APP; h) error, omission, or delay in the provision of any information provided or made available to the User.

AKRON may modify, restrict access to, or suspend the services available in the AKRON EV APP or regarding the AKRON EV Charging Stations at any time, including, without limitation, when necessary for our internal business operations, to reflect changes in laws and regulatory requirements, or when due to circumstances beyond our control.

Liability

The User will be responsible and must indemnify AKRON for any loss, damage, fine, or claim that may arise in relation to: (i) their breach of these Terms and Conditions; (ii) negligence, misuse, alteration, or deliberate damage to any AKRON EV Charging Station and/or its accessories, software of the AKRON EV Charging Stations, AKRON EV APP, facilities where an AKRON EV Charging Station is located; (iii) any unauthorized use of the AKRON EV APP; (iv) any unauthorized use of Stripe. This obligation will not apply to the extent that the damage or loss is caused by a negligent act or omission by AKRON.
To the extent permitted by applicable laws, AKRON will not be liable for any loss or damage that the User may suffer in relation to: (i) the use of the AKRON EV Charging Stations; (ii) any information contained in the AKRON EV APP that is incorrect, incomplete, or not up to date; (iii) loss or corruption of data sent, uploaded, or entered into the AKRON EV APP. This release of liability will not apply to the extent that the damage or loss is caused by a negligent act or omission by AKRON.

AKRON may change, suspend, discontinue, or restrict access to the AKRON EV APP or the AKRON EV Charging Stations without prior notice or liability if: a) you misuse or damage any AKRON EV Charging Station and/or its accessories and/or the AKRON EV APP; b) you provide false or inaccurate information to AKRON; c) any payment to AKRON is canceled, reversed, or rejected.

Payment Method

To complete the charging of the electric/hybrid vehicle through the AKRON EV Charging Stations, payment must be made through one of our approved payment methods. The User authorizes AKRON to use the selected payment method to process the payment of charges and any other amount that the User must pay for the use of the AKRON EV Charging Station and/or in accordance with these Terms and Conditions. AKRON reserves the right to modify the charges initially reflected in the AKRON EV APP when charging the electric/hybrid vehicle, as these are merely indicative. Therefore, the User acknowledges and agrees that the final charges may differ from the charge initially reflected in the AKRON EV APP. AKRON will make reasonable efforts to inform the User of the charges that may apply, provided that the User is responsible for the charges incurred in their account, regardless of whether the User is aware of such charges or their amounts, for which AKRON will provide the User with the corresponding confirmation or receipts for each charge.
If any payment attempt made by the User is rejected or unsuccessful for any reason, the User must use a different payment method. If your payment is rejected or reversed, AKRON may later charge you any fees incurred by AKRON in connection with the rejected or reversed payment. AKRON reserves the right to recover outstanding charges and associated fees, either directly or indirectly, through third parties, and AKRON may also charge recovery fees and dispute fees. AKRON EV will have the right to charge at any time the outstanding payments corresponding to charging sessions carried out in previous months. These charges will only be made for valid charges recorded in our system. By using our services, the User accepts this condition and agrees to maintain an active payment method with sufficient funds to cover any outstanding balance.

AKRON does not store sensitive payment method data, as payments are made through a third party that has the necessary PCI certifications to securely store and process banking transactions.

When paying with a credit or debit card, the User will be redirected to the “Stripe” payment platform. Therefore, by carrying out any operation and/or service in the AKRON EV APP, the User is also accepting the Consumer Terms of Service of “Stripe.” Stripe is an independent controller that will collect, store, and process your personal banking information, which may include sensitive data. Stripe’s privacy statement is available at https://stripe.com/en-mx/privacy. The Stripe payment platform may use a pre-authorization hold on your credit or debit card. AKRON is not responsible or liable for the above, so if you have any questions about a pre-authorization hold, you should contact your bank card issuer. AKRON staff or, where applicable for AKRON EV APP users, the App Store or Google Play, will only have access to the information of the last four digits of your payment bank card.

Use of the AKRON EV APP and AKRON EV Charging Stations

AKRON will make AKRON EV Charging Stations available for Users to use to charge their electric or hybrid vehicle through the AKRON EV APP. Users of the AKRON EV Charging Stations will pay for the service of charging their electric/hybrid vehicle for the time they are connected to the hoses of the AKRON EV Charging Stations.

Privacy and Protection of Personal Data

AKRON will collect personal information from the User in relation to the use of the AKRON EV Charging Stations and the use of the AKRON EV APP. Some examples of personal information that will be collected by AKRON, including without limitation, will be: name, email, phone, address, tax data (“Personal Data”). Likewise, AKRON may collect information related to your location, information about interaction with the AKRON EV APP and the AKRON EV Charging Stations.
AKRON may disclose your personal information and other data that we may collect in relation to the use of the AKRON EV APP and the AKRON EV Charging Stations to third parties, at its sole discretion, and may use it, including without limitation, for commercial communication purposes with the User, marketing, consumer behavior, statistical purposes, among others. At any time, the User may request to unsubscribe from commercial communication messages in accordance with the procedures established by AKRON.

Communication messages to AKRON EV APP users will update, including without limitation, on new features and products that will be carried out in the AKRON EV APP, including without limitation, such as new charging rates, premium plans, loyalty plans, etc.

AKRON will make its best effort to maintain the confidentiality and security of Personal Data, but will not be liable for damages that may arise from the breach of the measures it adopts by third parties who use public networks or the Internet to access such information.

Changes and Updates to Service and Terms and Conditions

AKRON may modify, at its discretion, without prior notice, these Terms and Conditions from time to time, as well as the applicable charges for the use of the AKRON EV Charging Stations. The current version of the Terms and Conditions of Use will be available on our website and through the “Settings” section of the AKRON EV APP. The applicable charges will be displayed in the AKRON EV APP.
Access to the AKRON EV APP and the use of the AKRON EV Charging Stations after the publication of any changes to these Terms and Conditions and/or the charges for the AKRON EV Charging Stations will be considered as acceptance of such changes and the current version of the Terms and Conditions. If you do not agree with the current version of the AKRON EV Terms and Conditions of Use or the charges for the use of AKRON EV Charging Stations, you must not use the services in any way and must delete the AKRON EV APP from your mobile device.

AKRON EV may send communication messages to AKRON EV APP users via email, which will communicate, including without limitation, about new features and products that will be carried out in the AKRON EV APP, including without limitation, new charging rates, premium plans, loyalty plans, etc., as well as the current Terms and Conditions. At no time will AKRON request access keys, PINs, or information about Users’ accounts or Credit or Debit Cards.

Intellectual Property

AKRON and/or its affiliated, parent, controlled, subsidiary, or related companies, as well as its related companies, are the owners of all intellectual property rights over their sites, all their content, services, products, trademarks, trade names, logos, designs, images, advertising slogans, copyrights, domains, computer programs, codes, developments, software, databases, information, technology, patents, and utility models, industrial designs, trade secrets, among others (hereinafter “Intellectual Property”), and are protected by national and international laws. Under no circumstances will it be understood that the User has any type of rights over them, regardless of the rights granted in these Terms and Conditions.
Subject to compliance with these Terms and Conditions of Use, AKRON authorizes the User to use its Intellectual Property, solely and exclusively, to install, view, use, and access the AKRON EV APP during the validity of these Terms and Conditions, for their legitimate personal purposes and, as authorized by AKRON. Therefore, the User may not market the AKRON EV APP or misuse it, nor may they use the name, trademark, or logo of AKRON EV or AK Logística. The User agrees not to copy, reproduce, disseminate, publish, transmit, or distribute, or otherwise deal with the Intellectual Property rights of AKRON and/or its affiliated, parent, controlled, subsidiary, or related companies, nor allow others to do so, except to the extent permitted by these Terms and Conditions; any other use of the Intellectual Property of AKRON and/or its affiliated, parent, controlled, subsidiary, or related companies is strictly prohibited. Likewise, to the extent that the User complies with these limitations, AKRON grants a non-transferable, non-exclusive, non-sublicensable, royalty-free, and revocable license.

Dispute and Applicable Jurisdiction

These Terms and Conditions of Use are governed entirely by Mexican law. For the resolution of any conflict related to their interpretation or application, the User expressly submits to the jurisdiction of the competent courts of the First Judicial District of the State of Jalisco, Mexico.

Termination of the “AKRON EV Contract”:

AKRON and the User may, at any time during the validity of this AKRON EV Contract, terminate it without stating any cause, which will imply the closure of the account. However, this will not suspend the fulfillment of all pending obligations between the parties at the time of notifying the termination, including without limitation, the debt to the other party or to third parties involved in the operations, or the fulfillment of any obligation.
Likewise, AKRON may, in case of breach by the User of any of the Terms and Conditions or applicable legislation, terminate this AKRON EV Contract without any prior notice, reserving the right to claim the damages and losses that such breach may have caused.

General Conditions

User Responsibility:

It will be the User’s responsibility to correctly select the appropriate connector for their vehicle, ensuring that it is properly connected to the charger. Likewise, the User must select the charging option that best suits the specifications recommended by the vehicle manufacturer. In case of doubt, the User is recommended to consult the vehicle manual or request advice to ensure that the correct power is being used.

Vehicle Compatibility:

The User must ensure that their vehicle is compatible with the charging power provided by the charger. To the extent that the vehicle has charging limitations, such as hourly or power restrictions, it will be the User’s responsibility to be aware of these specifications to avoid any compatibility issues.

Customer Service:

The Customer Service team will be available to provide assistance with doubts, technical problems, or queries related to the use of AKRON EV electric chargers. Communication can be made through the following channels: WhatsApp for quick and effective assistance, email to electromovilidad@akron.com.mx for detailed inquiries or specific reports, and phone calls to 33 1699 4044 for immediate attention or cases that require a more direct conversation.

To receive support, it will be necessary to provide the following information: charging point (location), name, a clear and specific description of the problem or doubt, the connector number, the date and time when the incident occurred, the model and type of vehicle, as well as any screenshots or photos related to the error or situation that arises. Having this information will allow our team to attend to your request more efficiently and accurately.

Dynamic Rate

AKRON EV offers a dynamic rate scheme that allows Users to choose the power at which they want to charge their vehicle and the cost they will pay for it.
The User will be responsible for selecting the charging option that best suits the specifications recommended by the vehicle manufacturer before starting the charge. Once started, it will not be possible to modify the chosen power. AKRON EV does not guarantee that the vehicle will reach the maximum power of the charger, as each car has its own limitations set by the manufacturer.

AKRON EV may establish consumption limits without prior notice. If the established limit is exceeded, the charge will automatically stop, and if the vehicle remains connected without being in the charging process for more than 15 minutes, the inactivity fee may be applied.

Inactivity Fee

When a vehicle remains connected to the charger without consuming energy, an inactivity fee will be applied. This measure seeks to optimize the use of the chargers and ensure their availability for other users.
The inactivity fee will be applied in the following cases:

  • If the vehicle has completed its charge and has reached the percentage configured by the User.
  • If the vehicle has internal settings that limit the charge to certain times, energy levels, or that stop the charge due to internal adjustments.
  • If the vehicle enters rest mode or stops charging for technical or safety reasons.
  • If the User ends the session from the application but leaves the vehicle physically connected to the charger.
  • If the charger hose is not properly connected to the vehicle.
  • If the User disconnects the charger from their vehicle but does not end the session from the AKRON EV application.

It will be the User’s responsibility to monitor their charging session and ensure that the vehicle is properly connected and in the charging process. AKRON EV will not be responsible for situations arising from internal vehicle settings, errors in connecting the charger, lack of knowledge of the ideal power, or failure to review notifications sent to the registered email and/or application.
The User is recommended to check their email and/or mobile application to be aware of the status of their charge, including notifications about charge suspension, end of grace period, and the moment when the vehicle stops consuming energy.

A grace period of 15 minutes will be granted from the moment the vehicle stops consuming energy. After this time, the inactivity fee will be charged per minute plus VAT, applying continuously until the vehicle is disconnected from the charger.

Refund and Compensation Policy

Once the charging service has started, no refund will be made, whether due to cancellation or any other reason. By using the service, the User confirms that they have read and understood the terms and conditions and that they agree with them. Additionally, the User accepts that they have no right to receive a refund after the service has started. Refund requests will be rejected, and no refunds will be granted if the User decides to cancel or delete their AKRON EV account voluntarily.
At AKRON EV, no fee is refundable, except in cases where it has been charged due to a technical problem with our infrastructure. In such cases, AKRON EV will compensate the User with an equivalent of free charging hours. Below are the cases that may be eligible for compensation and the corresponding hours.

Technical problems that are AKRON EV’s responsibility:

  • Internet connection failures.
  • Disconnection of the charger from the network.
  • Unexpected shutdown of the charger.
  • Failures when installing updates or software versions that cause service interruptions.

Situations that are NOT AKRON EV’s responsibility:

  • Charging limitations imposed by the car’s system, such as times or energy levels.
  • The charger hose is not properly connected to the car’s port.
  • The User ends the session from the application without physically disconnecting the vehicle.
  • The User disconnects the car but never ends the session in their app.
  • The User does not close the session when their charge is complete.
  • The vehicle is not compatible with the selected power level or has internal charging issues.
  • The User is not attentive to the emails informing them about the status of the charge.
  • Disconnection or manipulation of the charger by other people.
  • Problems with the car’s battery or internal charging system.

Compensation for AKRON EV’s technical problems

  • P: Total payment by the User
  • N: Charging power level (in kW)
  • C: Cost per kWh
  • I: VAT percentage (16%)
  • T: Compensation hours
  • T = (P / (C * (1 + I))) / N
  • T = Hours with decimals
  • Hours = Integer hours
  • Minutes = Decimals * 60 = minutes

Billing

Invoices will be processed on the 15th-16th and 30th-31st of each month and will only include invoices for charging sessions carried out within the current month. Charges from previous months cannot be invoiced. If you have any doubts, make sure to consult them before the end of the month, as it will not be possible to invoice for past months afterwards.

Misuse of Promotional Codes

The use of promotional codes must be carried out in accordance with the conditions established by AKRON EV. Each promotional code will be limited to a single use per account. AKRON EV will monitor the activity of promotional codes and, in case of detecting unusual or unauthorized use, the promotional code will be suspended. Any attempt to distribute or misuse the codes may lead to the cancellation of the User’s account and the revocation of the benefits obtained.
